Do I pay the 3% Surcharge?
If you already own a residential property anywhere in the world (worth more than £40k) and you are buying another one in England or Northern Ireland, you usually have to pay the 3% surcharge on top of standard SDLT rates.
Can I claim this as an expense?
No. Stamp Duty is a Capital Expense. You cannot deduct it from your monthly rental income tax. However, you can deduct it from your Capital Gains Tax calculation when you eventually sell the property.
